ACCURACY IN LEGAL TRANSLATION –
WHY IT MATTERS

Legal translation is key to ensuring due process and effective representation for clients who do not speak English. A few weeks ago, a U.S. litigation law firm contacted me for a Spanish-to-English legal translation. Their client, a South American company, had sent over court orders issued in Spanish. The firm needed those documents translated to understand what had happened in the case and what the judge had ruled. With that information, they could develop their litigation strategy in the U.S. and decide how to move forward.

This is exactly the kind of work I specialize in: legal translation for lawyers and law firms. Behind the request to “translate,” there’s a deeper need: to understand a case and represent non-English-speaking clients effectively.

This is where accuracy becomes crucial. Legal translation means preserving legal meaning between different systems, while maintaining structure and intent. For example, the final ruling included specific legal terminology related to the legal procedure and corporate laws of that South American country—terminology that doesn’t have direct equivalents in the U.S. legal system. Accurately translating this terminology was key for the U.S. legal team to fully understand the ruling and decide how to proceed.

STEP 1: UNDERSTAND THE LEGAL DOCUMENT

Before starting any legal translation project, I need to fully understand the document itself. Who drafted it? What is its purpose? Is it part of a larger case file? A clear understanding of the legal background ensures the translation reflects not just the language, but the document’s true legal meaning.

STEP 2: UNDERSTAND THE LEGAL SYSTEMS INVOLVED

As I said, legal translation doesn’t just involve translating between languages; it involves translating between legal systems. In this project, the original documents were issued in a South American country that follows the Civil Law legal system, and needed to be translated into US legal English, which follows the Common Law legal system. This is a crucial part of my work, as many legal terms don’t have a direct equivalent in the other system, or their legal definition is similar but not exactly the same.

In addition to reviewing the legal systems involved, I also pay close attention to the specific legal terminology and laws of the country where the document was issued, especially in corporate law. In fact, this project involved a corporate law matter, which is the area where I most often find significant differences in terminology among Spanish-speaking countries.

STEP 3: IDENTIFY THE PURPOSE OF THE TRANSLATION

Who will read the translation—a lawyer, a client, a judge? The intended audience shapes many of my choices on how to translate a legal term, including whether to add a Translator’s Note to explain a legal term that might not be familiar in the target legal system.

In this case, the legal team needed clarity to advise their client. Therefore, I provided a Project Glossary that included key legal terms within the court documents, my translation choices, notes, and supporting resources. This is an important added service that many of my international law firm clients value, because it allows them to quickly review important legal terms, see how they were translated, and understand their meaning in context. For example, a client told me the glossary helped their team understand the types of corporate entities mentioned in the documents. Although their definitions have some similarities in the US, these entities don’t have exact equivalents, and the rules governing them vary significantly.

STEP 4: ENSURE CONSISTENCY IN TERMINOLOGY

When providing professional legal translation services, accuracy also means ensuring that the translated legal terminology remains consistent throughout the entire document. In other words, once I choose a specific translation for a term, I commit to using that same translation consistently across the entire text—and, for recurring clients, across projects—to avoid confusion and ensure coherence.

However, it’s important to note that in some cases, the context may allow for different translations of certain terms. Depending on the specific legal context or the intended meaning in a particular section, a variation in translation might be necessary to preserve clarity.

STEP 5: PROOFREAD FOR PERFECTION

No document leaves my desk without a final review (or I will say a million “final” reviews). I proofread the entire translation for spelling, grammar, and terminological accuracy. This way, the legal team receives a clear and professional document they can use right away.

STEP 6: MATCH THE ORIGINAL FORMAT

Legal documents always follow a specific format, which depends on the type of document. In many cases, laws or official guidelines establish how those documents must be structured. Even though translations are not bound by those same rules, I always make sure the translation follows the original document’s structure and format as closely as possible. This allows my clients to easily find the information they need and ensures the translated document is clear, accurate, and ready to use.

For example, when I translate contracts from English to Spanish—specifically U.S. contracts—I keep the formatting of defined terms. If the contract defines a word like “Services” with a capital letter and uses it that way throughout, I do the same in Spanish and write “Servicios” with a capital “S.” In Spanish, capitalizing a common noun in the middle of a sentence is considered a grammatical mistake, but in legal translation, keeping the capitalization helps show that the word has a specific meaning in the contract. Most importantly, it keeps the meaning clear for the reader.
